It is legal to record the police. But that doesn't always stop them from arresting you. Client David Bell learned this important lesson in Spring 2014, when he was arrested after filming a violent arrest in Brooklyn.
In an effort to seize the video and punish Mr. Bell for recording, officers fabricated charges that Mr. Bell had picked up a crack pipe, crushed it with his shoe and then resisted arrest:
Harvis & Fett brought a civil rights action in the Eastern District of New York on behalf of Mr. Bell. These officers are known to the firm from other cases and instances of bizarre behavior, including referring to a female online commenter as a "retard" (in context here).
To its credit, the City quickly settled the case.
